Noxidox – Terms of Use

Noxidox is a privacy-oriented mobile application for AI-assisted search, summarization, and analysis of documents. The core functions of Noxidox include, in particular, the processing and analysis of supported document formats and the answering of User queries based on documents provided by the User. Document processing and AI-assisted analysis are generally performed locally on the User's device using Apple's Foundation Models and/or Apple Intelligence technologies. The Provider does not operate its own cloud-based AI service for the actual analysis of documents. Use of the App requires a compatible Apple device and a supported version of iOS. As of the effective date of these Terms, Noxidox requires at least iOS 26 and a compatible device with an A17 Pro chip or newer. The applicable technical requirements may change as a result of further development of Noxidox, iOS, or the underlying Apple technologies.

Noxidox is offered in a free and a paid usage tier:

• up to 3 projects,
• up to 10 documents per project,

The Provider may modify the usage limits of the free tier in accordance with applicable law, in particular where this is required or reasonably justified for technical, economic, or security-related reasons. Material changes will be communicated to the User in an appropriate manner.

• unlimited projects,
• unlimited documents,
• extended conversation history,
• optional iCloud synchronization across compatible Apple devices.

The specific feature set may be further developed in accordance with applicable law.

Noxidox uses artificial intelligence (Foundation Models) to help you analyze your documents. Due to the technical nature of these models, generated responses may be incomplete, taken out of context, or factually inaccurate. The app is intended solely as a tool. The AI-generated results do not constitute legal, tax, medical, financial, or any other professional advice. Users are required to always verify information that is material to them by referring to the original documents and to seek professional advice when necessary.

Noxidox Pro is offered as a monthly and an annual subscription. The applicable prices and billing periods are displayed to the User in the Apple App Store before the subscription is purchased. The price displayed in the Apple App Store at the time of purchase is decisive for the respective transaction. Prices may vary depending on the country, region, currency, and storefront.

Where offered through the Apple App Store, new subscribers may be provided with a free trial period. The duration and terms of the free trial are displayed to the User in the Apple App Store before the subscription is purchased. Unless the subscription is cancelled in accordance with Apple's requirements before the end of the trial period, the paid subscription will commence after the trial period and the applicable price for the relevant billing period will be charged. Where provided by Apple, a free trial may only be used once per Apple ID and subscription group.

Subscriptions are purchased and billed through the Apple App Store and/or the payment system associated with the User's Apple ID. The Provider does not have access to the User's complete payment details. Apple's applicable terms and conditions additionally apply to payment processing.

The subscription automatically renews for the applicable billing period unless the User cancels the subscription in good time before the end of the current billing period using the subscription management functions provided by Apple. The applicable Apple rules govern the timing and procedure for cancelling a subscription.

The Provider may change the prices for Noxidox Pro in accordance with applicable law. In the event of a price change, Apple's applicable information and consent requirements shall apply. Where required, the User will be informed in good time of an upcoming price change.

The User may cancel their Noxidox Pro subscription at any time using Apple's subscription management functions. In particular, the subscription may be cancelled via:

• iPhone / iPad: Settings → [Name] → Subscriptions → Noxidox Pro → Cancel Subscription
• or through the corresponding subscription management functions in the App Store.

The applicable Apple instructions and functionality in effect at the relevant time shall govern. Unless otherwise provided by law, cancellation will generally take effect at the end of the billing period that has already been paid for.

Following a valid cancellation, the User may generally continue to use the paid features until the end of the billing period that has already been paid for. After the subscription period ends, the User's account and/or access will be returned to the free tier, where such a tier is available. Documents and projects exceeding the limits applicable to the free tier may generally remain stored. Functions that are unavailable due to exceeding those limits may only become available again if the User has an active Noxidox Pro subscription or reduces the affected content to within the applicable limits.

The Provider may terminate the user agreement for good cause. Good cause exists, in particular, if the user circumvents the app’s security measures, uses the app to infringe the rights of third parties, or interferes with the technical infrastructure in a manner that impairs the app’s operation for other users.

For the duration of the contractual relationship, the Provider grants the User a simple, non-exclusive, non-transferable right to use Noxidox on the User's own or otherwise lawfully used compatible Apple devices for its intended purpose. Use is generally limited to the purposes provided for by the respective offering. Mandatory statutory rights of use remain unaffected.

The App, including its software, source code, user interface, designs, texts, graphics, trademarks, logos, and other components, is protected by copyright and/or other applicable intellectual property laws. Unless expressly stated otherwise or required by law, all rights to these components remain with the Provider or the respective licensors. Use of the App does not grant the User any further rights to the Provider's intellectual property.

The User may use Noxidox only in accordance with these Terms and applicable law. In particular, the User is prohibited from:

• reproducing, distributing, renting, or sublicensing the App without authorization;
• decompiling, disassembling, or reverse engineering the App without authorization, except where expressly permitted by mandatory law;
• circumventing security mechanisms or technical protection measures of the App without authorization;
• using the App for unlawful purposes;
• using automated access, queries, or other methods that interfere with the intended operation of the App;
• using the App to infringe the rights of third parties.

The User is responsible for ensuring that they are legally entitled to process the documents and content imported into Noxidox. In particular, the User must not process content where such use or processing violates applicable law or the rights of third parties. Because document processing generally takes place on the User's device, the Provider does not have regular access to document content stored or processed by the User in Noxidox.

Noxidox is not a standalone data backup service. The User is responsible for independently backing up original files and other data that is important to them in an appropriate manner. Optional iCloud synchronization does not necessarily replace an independent backup of important original files.

You represent and warrant that (i) you are not located in a country that is subject to a U.S. government embargo or has been designated by the U.S. government as a “state sponsor of terrorism” country, and (ii) you are not listed on any U.S. government list of prohibited or restricted parties.

The Provider endeavors to make Noxidox available as reliably and continuously as reasonably possible. However, uninterrupted, continuous, or completely error-free availability cannot be guaranteed. Availability and functionality may be affected by factors outside the Provider's control, including:

• errors or changes in iOS,
• changes to or limitations of Apple technologies,
• device or hardware problems,
• operating system updates,
• limitations of third-party services,
• technical disruptions,
• maintenance, or
• other circumstances beyond the Provider's reasonable control.

Statutory rights of the User arising from non-conforming provision remain unaffected.

Noxidox requires a compatible Apple device and a supported version of iOS. The applicable minimum requirements are stated in the App and/or Apple App Store. As of the effective date of these Terms, Noxidox requires at least iOS 26 and a compatible Apple device with an A17 Pro chip or newer. The Provider may further develop the technical minimum requirements where this is required or reasonably justified due to technological developments, security requirements, or changes to the underlying Apple technologies.

The Provider may further develop, improve, and update Noxidox. Where required by law, the Provider will provide updates necessary to maintain the conformity of the digital product with the contract. The User is responsible for installing available updates within a reasonable period and maintaining the technical requirements necessary to use the App. The statutory provisions governing update obligations and the consequences of failing to install updates remain unaffected.

No warranty, regardless of fault, is provided regarding the accuracy, completeness, or suitability of the AI-generated outputs for a specific purpose. When making decisions with significant legal, economic, health, or other implications, the user must not rely exclusively on the AI-generated results but must review them independently. In the event of damages resulting from the unchecked adoption of AI results, the user must accept a corresponding degree of contributory negligence.

The Provider shall be liable without limitation for damages resulting from injury to life, body, or health where such damages are caused by a negligent breach of duty by the Provider or by an intentional or negligent breach of duty by its legal representatives or agents. For all other damages, the Provider shall be liable without limitation in cases of intent and gross negligence. In cases of slight negligence involving a breach of a material contractual obligation, the Provider shall only be liable for foreseeable and typical damages. Material contractual obligations are obligations whose fulfillment is essential for the proper performance of the contract and on whose fulfillment the User may regularly rely. To the extent legally permissible, the Provider shall otherwise not be liable for damages caused by slight negligence. The foregoing limitations of liability shall not apply where mandatory statutory liability applies, in particular under applicable product liability law, or where the Provider has expressly provided a guarantee or fraudulently concealed a defect.

The liability provisions of this § 8 also apply to damages arising in connection with an AI-generated result produced by Noxidox. However, the description of the technical limitations of automated document analysis in these Terms does not limit any mandatory statutory liability or statutory rights relating to defects. In particular, the description of the technical limitations does not exclude any statutory claim where Noxidox itself has not been provided in conformity with the contract or where another statutory basis for liability exists.

The User is responsible for backing up original documents and other data that is important to them. Where data loss is caused by a slightly negligent breach of a material contractual obligation, the Provider's liability shall be governed by the limitation of liability set out in § 8.5. Liability for data loss caused intentionally or through gross negligence, as well as mandatory statutory liability, remains unaffected.

Noxidox is offered through the Apple App Store. Certain technical functions of the App may depend on technologies and services provided by Apple, including iOS, Apple Intelligence, Foundation Models, and iCloud. The applicable terms and policies of the relevant third-party providers additionally apply to such third-party services. The Provider has no control over the future availability, technical design, or development of third-party services. Changes to, restrictions on, or discontinuation of a third-party service may require individual functions of Noxidox to be modified or may result in such functions becoming temporarily or permanently unavailable. Apple is not a party to these Terms with regard to the services offered by Noxidox. To the extent that the contract for Noxidox Pro is concluded between the User and the Provider, the Provider remains the contractual party responsible for the services owed by the Provider. Payment processing and certain administrative subscription functions are handled through Apple. Apple's applicable terms additionally apply to these functions.

These terms are entered into solely between you and the provider, not with Apple. The provider, not Apple, is solely responsible for the app and its content. Apple has no obligation to provide maintenance or support services for the app. In the event of a defect, you may notify Apple, and Apple may, at its discretion, refund the purchase price; any further warranty claims against Apple are excluded. The provider, not Apple, is responsible for resolving any claims by you or third parties regarding the app (including product liability, legal requirements, and consumer protection). Apple and Apple’s subsidiaries are third-party beneficiaries of these terms and are entitled to enforce these terms against you.

The Provider may further develop Noxidox from a technical and functional perspective. Changes may be made in particular to:

• comply with security requirements,
• correct errors,
• improve technical stability,
• support new operating system or hardware generations,
• adapt to technical dependencies on Apple,
• further develop existing functions, or
• introduce new functions.

Mandatory statutory requirements governing changes to digital products remain unaffected.

The Provider may amend these Terms where this is required or reasonably appropriate due to changes in applicable law, technological developments, changes to the services offered, or other objective reasons. Material changes will be communicated to the User in an appropriate manner. Where a change materially affects the User's rights and applicable law provides for specific information or termination rights, the statutory requirements will be complied with.

Changes to these Terms shall not exclude or restrict any mandatory statutory rights of the User.

The law of the Federal Republic of Germany shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG), to the extent that this does not conflict with mandatory consumer protection provisions. Where the User is a consumer habitually resident in another Member State of the European Union, this choice of law shall apply only to the extent that it does not deprive the consumer of the protection afforded by mandatory provisions of the law of their country of habitual residence.

If the User is a merchant, a legal entity under public law, or a special fund under public law, the courts at the Provider's registered office shall have jurisdiction, to the extent legally permissible, over all disputes arising from the contractual relationship. The statutory rules on jurisdiction apply to consumers.

The Provider is neither obliged nor, in principle, willing to participate in dispute resolution proceedings before a consumer arbitration board. The Provider will provide any information regarding consumer dispute resolution required by applicable law. The former European Commission Online Dispute Resolution platform is not referenced because it was discontinued on 20 July 2025.
